Booking Conditions 2012
All bookings are accepted on the following terms:
1a. The Holiday Accommodation Agency acts as Booking Agent for the owners of the holiday homes. 1b. The contract, once formed, will lie between you, the holidaymaker and the owner (the owner) of the property in respect of which the booking is made. The Holiday Accommodation Agency acts solely in the capacity of a Booking Agent and is not party to the contract.
2. No contract exists until a completed booking form has been received by us with a deposit of £85 and a booking fee (if applicable), and our confirmation of the booking has been dispatched. Thereafter the holidaymaker becomes liable for the balance of the rent and this must be paid six weeks before the date of the commencement of the holiday.
3. The booking shall be deemed to be for the purpose of the people whose names appear on the booking form. The maximum number of persons allowed at the property is clearly stated in the particulars and must not be exceeded without prior consent of the property owner. In the event that the maximum number is exceeded without prior consent as aforesaid, the owner has the right to revoke the booking. The owner will be expected to retain an amount consistent with his expected profit. The Holiday Accommodation Agency and the owners reserve the right to refuse or revoke any bookings from parties which may in their opinion be unsuitable for the property concerned.
4a. If you are forced to cancel your holiday you must inform The Ingrid Flute Holiday Agency immediately see Cancellation/Curtailment Protection Scheme (CPS) for details of how to make a claim. In all cases of cancellation where the reason for cancellation is not covered by the CPS, the deposit is forfeited. Our CPS is automatically arranged for you and is included in the cost of your holiday. This protects you for all or part of your responsibility for the balance of hire terms and/or deposit if you cancel for one of the qualifying reasons set out in the CPS. A cancellation made for reasons outside these listed in the CPS are nor protected in this way, and you will remain liable for full payment unless we are able to relet all or part of the period booked. It is possible to opt out of this scheme but there is no monetary value to the hirer and the hire charge will have to be paid in full. The CPS does not extend to oversees bookings and these visitors are advised to make their own arrangements to ensure cover.
4b. If you want to change your booking from one property to another after having paid the deposit, a second deposit is required until such time as the original property has been relet.
5. If for any reason it proves necessary for us to make a change in your holiday booking by reason of the unexpected withdrawal of the property by the owner, or for some other reason, we will endeavour to make an alternative booking, or failing this we will refund to you any monies paid by you.
6. The property Owner will only accept liability for economic loss when caused by negligence of the property owner or his representative.
7. You are obliged to keep the holiday home and all furnishings, fittings and effects, in the same state of repair and conditions they are in at the commencement of the holiday and to ensure that the home is left clean and tidy. In default of such obligation, you are obliged to reimburse the owner against any costs incurred by the owner in remedying such default.
8. You will be responsible for any damage to the holiday home, or the furniture, fittings and effects. Anything broken or damaged should forthwith be repaired or replaced with an article of similar type and value. If this is not possible, any damage or breakage should be reported to the owner, and paid for before departure.
9. You will permit the owner or us (with or without workmen or others) at reasonable times and on a reasonable notice enter and inspect, and if necessary to repair the property or to enter the property without notice in an emergency to repair the property or adjoining premises.
10. You must not assign or part with the possession of the property or any part of it, or anything contained in the property or use it other than as a single dwelling for holiday occupation by the people whose names appear in the booking form.
11. You must ensure that nothing which may be a nuisance or inconvenience to occupiers of neighbouring or adjoining property or adversely affect any insurance of the property.
12. It is clearly stated in the particulars whether or not pets are allowed at the property. This must be strictly adhered to. If pets are allowed, then you must keep them under strict control. You must not leave pets unattended in the properties and you must exercise them away from the premises. Pets are not allowed in the bedrooms or on the furniture.
13. If you feel you have a genuine complaint in respect of your holiday home, then this should immediately be reported to the owner or to us. We can take no personal responsibility in this respect, but will refer it to the owner or his representative.
14. These conditions shall be deemed to have been accepted by you at the time when you completed the booking form.
15. The particulars set out in the brochure and any supplement to the brochure are believed to be correct at the time of printing.
These Booking Conditions shall be read and construed in such a way so as not to prejudice the statutory rights of the holidaymaker.
